Barring an objection, I will be posting a procedural motion to revise (bold
text indicating changes):
"Abd is prohibited from participating in discussion of any dispute in which
he is not one of the originating parties*, unless approved by his mentor(s)*.
This includes, but is not limited to, article talk and user talk pages, the
administrator noticeboards, and any formal or informal dispute
resolution<http://en.wikipedia.org/wiki/Wikipedia:DR>.
He would be allowed to vote or comment at polls."

to

"Abd is *indefinitely* prohibited from participating in discussion of any
dispute in which he is not one of the originating parties. This includes,
but is not limited to, article talk and user talk pages, the administrator
noticeboards, and any formal or informal dispute
resolution<http://en.wikipedia.org/wiki/Wikipedia:DR>.
He would be allowed to vote or comment at polls."

Rationale:
No mentorship remedies passed, thus the mentor(s) clause is inoperative.
This would clear up some confusion (and what I see as system gaming) on this
point.

No duration was specified. In the absence of an undetermined period, it is
traditional to explicitly note the indefinite duration.

In the absence of any significant objections, I will post this to the
motions page a bit later today.

Comments? Feedback?

Pete

Looks good to me but could we have a light copyedit? I suggest:

"Abd is indefinitely prohibited from discussing any dispute in which
he is not an originating party. This includes, but is not limited
to, article talk and user talk pages, the administrator
noticeboards, and any formal or informal dispute resolution. He may,
however, vote or comment at polls."

I will support as well. Shall we put this on-wiki as a motion? I'd like
this to be addressed centrally so that we don't have this discussion
cluttering multiple pages, as it appears to be doing now.

Thanks,

Incidentally, this doesn't specifically include arbitration pages. Is

I've always thought of arbitration as part of "formal dispute resolution",
but YMMV...

We'd be hard pressed to not include arbitration under "formal or
informal dispute resolution".

I'll recuse from this as an incident relating to Abd, but would comment that
he contacted me yesterday asking me to be his mentor. A slightly less
dramatic mechanism would be for me to accept this role, maintaining my
recusal from Abd in arbitration-related matters - I would not plan to allow
Abd any editing of Arbcom cases.

Of course, I'm not in a position to judge how this would now be perceived
given my new responsibilities. Since I'm recused anyway, I'll allow you to
judge this as a possible alternative and will monitor this thread and only
comment as necessary.

Best,
Fred

I am not sure if it is a good idea for arbs to be actively mentoring people
who have been before the committee, and could be before the committee again
in the future. Has this happened in the past?

Jpgordon "mentored" OrangeMarlin after the non-hearing about him in
June/July 2008. By mentoring, I believe the understanding was "I'll block
you if you cross the line", rather than the more traditional form of
mentoring.

I tend to agree with Randy/Rlevse here; there may be a few circumstances
where it is appropriate but there's a big leap from recusing on active
matters to mentoring, particularly mentoring of someone who has been
extremely critical of the Committee.

On a more humorous note, I'd prefer that you read my long screeds to
Abd's....

I merely note that the offer is there. I too can envisage problems with it
- but perhaps his willingness for mentoring in this instance could suggets
this as a path (with an alternative mentor)

On the other hand, he is often a pain - keeping him out of DR might be the
simpler option.

Josh mentored Orangemarlin but that was done mostly to help ArbCom get out
of a very messy situation.

I will also recuse from Abd, as I was the clerk for that case. If
someone wouldn't mind noting that (or getting a clerk to do so) when the
motion gets up, that'd be awesome. I'd do so myself, but I'm having to
pay for internet minutes right now, and it's painfully slow, I think
deliberately. Thanks.

For what it's worth, I've never seen prior involvement in a case as a
clerk as warranting recusal, unless there were unusually hostile
interactions with one of the parties.

Recused from all Abd's cases as usual. I am recused because two years ago or
something I warned him firmly expecting something similar to this
restriction to happen but he didn't appreciate it. I could have not recused
but we have plenty of active arbs now.

Welcome to all our new arbs by the way and happy new year.

I believe it did happen at some point although I agree that it is not
appropriate.

Thanks, Pete.

Could one of the lawyers here have a look at the text please? My use of
the word "originating" may inadvertently prohibit him from responding to
matters to which others have enjoined him.

"Abd is indefinitely prohibited from discussing any dispute in which
he is not an originating party. This includes, but is not limited
to, article talk and user talk pages, the administrator
noticeboards, and any formal or informal dispute resolution pages.
He may, however, vote or comment at polls."

Sorry to keep picking at this. Thing is I don't like sweeping
restrictions like this very much and I'm concerned that we create fresh
problems for ourselves further down the line, requiring additional
clarification.

Subject: [arbcom-l] Summary of open requests for amendment or clarification
(01/17)
Message-ID: <3f797b9a1001170901wd60ad6emedb57799b588dacb@mail.gmail.com>

Below is a summary of currently open requests for amendment or
clarification. Any comments on these items -- particularly on the suggested
action for each -- would be very appreciated!

==========

Request for clarification: Abd-William M. Connolley (
https://secure.wikimedia.org/wikipedia/en/w...am_M._Connolley
)

Summary: WMC and Abd are arguing over a minor difference in interpretation
regarding Abd's topic ban; there doesn't appear to be any push for
clarification on the part of the enforcing administrators.

Suggested action: Unless there are any better ideas, I'm going to propose a
standard motion to prohibit WMC and Abd from interacting with or commenting
on each other.

==========

Request for clarification: Wikipedia:Arbitration/Requests/Case/Eastern
European mailing list (2) (
https://secure.wikimedia.org/wikipedia/en/w...ng_list_.282.29
)

Summary: Editors under topic bans in the case are asking for clarification
on whether those topic bans apply to articles such as "Mass killings under
Communist regimes".

Suggested action: Steve has provided a response, with which much of the
Committee has concurred. If there are no objections in the next day or so,
I'll ask the clerks to close the request.

==========

Request for clarification: Wikipedia:Arbitration/Requests/Case/Eastern
European mailing list (
https://secure.wikimedia.org/wikipedia/en/w...an_mailing_list
)

Summary: Editors under topic bans in the case are asking for clarification
on whether they apply to reverting vandalism.

Suggested action: Pete and Randy have provided a response, with which a
number of arbitrators have concurred. If there are no objections in the
next day or so, I'll ask the clerks to close the request.

==========

Request to amend prior case: Falun Gong (
https://secure.wikimedia.org/wikipedia/en/w...ase:_Falun_Gong
)

Summary: Enforcing administrators in this area have asked that the article
probation remedy be replaced with discretionary sanctions.

Suggested action: There is a motion to grant the request, which currently
stands at 7/0/0; a few additional votes will let us close this one out.

==========

Request to amend prior case: Speed of light (
https://secure.wikimedia.org/wikipedia/en/w..._Speed_of_light
)

Summary: Editors have asked that Brews ohare's topic ban be temporarily
waived to allow him to participate in discussion of images he has created
while the "Speed of light" article is at FAC.

Suggested action: Comments so far seem broadly supportive of the proposal;
unless anyone has a better idea, I'll propose a motion granting a narrow
lifting of the ban.

==========

Request to amend prior case: ARB9/11 (Thomas Basboll's topic ban) (
https://secure.wikimedia.org/wikipedia/en/w...7s_topic_ban.29
)

Summary: Thomas would like his indefinite topic ban changed to one of fixed
duration.

Suggested action: Arbitrator comments so far are generally negative; if
nobody expresses interest in changing the ban in the next day or so, I'll
ask the clerks to close the request as declined.

==========

Request to amend prior case: Asmahan (2) (
https://secure.wikimedia.org/wikipedia/en/w...Asmahan_.282.29
)

Summary: Supreme Deliciousness would like for Arab Cowboy's topic ban to be
made permanent in light of the latter's sockpuppetry.

Suggested action: NuclearWarfare appears to have dealt with the matter on an
enforcement level; if nobody expresses interest in altering the ban further
in the next day or so, I'll ask the clerks to close the request as declined.

Okay, I've asked the clerks to close most of these, and have proposed new
motions in two of the requests:

Request for clarification: Abd-William M. Connolley (
https://secure.wikimedia.org/wikipedia/en/w...am_M._Connolley
)

Request to amend prior case: Speed of light (
https://secure.wikimedia.org/wikipedia/en/w..._Speed_of_light
)

Comments and votes on both of these items would be appreciated.

We still need to keep moving forward with the currently open motions.
If people will be unable to vote, please say when you will be able to
vote, or abstain (sort of a way of going inactive on individual
motions). Currently we have:

1) http://en.wikipedia.org/wiki/Wikipedia:Arb...am_M._Connolley

Abd-WMC mutual interaction restriction. Still at 3/0/1, though now we
have 4 recusals that I entered, so of the 15 active arbs, 7 are left
to vote, majority is 6, even with Brad's abstention. Need three votes
to see it pass, or 5 opposes to see it fail (we should really be
removing these low-activity ones after 10 days if no-one bothers to
vote).

Those left to vote (it's not clear whether any of the new arbitrators
are recused or not) are:

Fritzpoll
Hersfold
KnightLago
Mailer diablo
Risker
Rlevse
Roger Davies

2) http://en.wikipedia.org/wiki/Wikipedia:Arb...e:_EEML_.282.29

Piotrus proxy editing. Currently at 6/0/0, with one recusal. Of the 15
active arbs, 9 are left to vote, majority is 8. If Frank and Fayssal
are marked as inactive, the majority reduces to 7, so either two more
or one more vote needed to pass this, or 8 opposes to see it fail.
This one is very close to passing, so let's try and get voting
finished here.

Those left to vote (it's not clear whether any of the new arbitrators
are recused or not) are:

Fritzpoll
Hersfold
KnightLago
Risker
Rlevse
Cool Hand Luke
FayssalF
Steve Smith
Shell Kinney

3) http://en.wikipedia.org/wiki/Wikipedia:Arb...rior_case:_EEML

Radek BLP sourcing. Two motions. Both currently at 6/0/0, with one
recusal. Of the 15 active arbs, 8 are left to vote, majority is 8. If
Frank and Fayssal are marked as inactive, the majority reduces to 7,
so either two more or one more vote needed to pass these, or 7 opposes
to see them fail. These ones are also very close to passing, so let's
try and get voting finished here.

Those left to vote (it's not clear whether any of the new arbitrators
are recused or not) are:

Fritzpoll
Hersfold
KnightLago
Risker
Rlevse
Cool Hand Luke
